日前一名想要到安省North Bay一所学校学习的中国男子在申请加拿大学习签证的时候，被移民官拒绝。随后他向联邦法庭提起了上诉。法院近期判他的上诉成功，但仍需要由新移民官来判定是否给他颁发学签。
据CTV报道，这名男子臧先生（音译，Mr. Zang）在2021年10月份向加拿大移民部申请学签，希望能到North Bay的Candadore学院学习项目管理专业。但是这个申请遭到了拒绝，因为移民官对于”申请者在完成学业后就会离开加拿大的理由”并不能完全相信。”鉴于申请者的就业和受教育经历，这个学习计划没有提供足够充分的理由，” 移民官在拒绝信中写道。
“申请者在计划来加拿大学习之前，有更高的学历水平。而且参考过他此前的受教育和工作经历，我无法相信他想要在这个时候来到加拿大学习这个项目的动机是合理的。”
臧先生随后向联邦法院提起上诉称，移民官的这个决定不公平。
联邦法院近日裁定，臧先生已经解释了他要来加拿大理由，这些原因是符合情理的。
“根据申请者的学习计划，他指出，原本他想要学建筑工程师专业，但由于不能满足入学成绩要求因此无法申请这类专业的学习项目，” 上诉法院在裁决书中写道。
臧先生从2010年开始从事建筑业，到了2017年时他已经在中国成了一个建筑项目经理。但由于他所工作的公司开始转向商业建筑，他之前没有受过此类学习和培训。
“申请者表明，因为自己没有这方面专业学习的经验，他在处理第一个商业建设项目的时候，感到很困难，” 判决书写道。”他意识到，需要回到学校进修来提高建筑项目管理方面的技能和知识。”于是他选择了Canadore学院，因为它的培训时间比中国类似学习项目要短。
“申请者的雇主也鼓励他这么做，同时还表示愿意在他学习期间给他保留职位，” 判决书中表示。”申请者也表明这个学院的建筑项目管理项目非常适合他，因为它项目学习时间短且课程密集，涵盖了多方面的内容，还会展开有关运用项目管理工具方面的深度教学。”
对于此前移民官提出的，无法完全相信他会在学习结束后离开加拿大的顾虑，上诉法院表示，申请者提供了强有力的证据表明自己有足够的理由。
“申请者指出他已经有工作岗位等候他学成回国，而且在中国有很强的家庭和社区联系，因为他的妻女不会陪伴他来加拿大，同时他也有充足的资金支持，这些他都提供了详细材料，” 判决书中写道。
在之前的判断中，移民官还对臧先生选择安省North Bay这所学校表示怀疑。”申请者未能解释自己为什么要从全球那么多国家的院校中非要选择加拿大的这所学校学习，North Bay这个学校距离中国9000公里远。”
不过上诉法院在判决书中表示，这位移民官的质疑并不能足以拒绝颁发学习签证。”我认为申请者不需要解释为什么他要选择这个学院。他已经说明这个学院的项目对他来说非常合适。”
综上理由，上诉法庭认为，这名申请者的上诉成功，驳回之前移民官的决定。不过臧先生仍然需要再次申请学习签证，只是这次将由另一位移民官来判定。
颐安点评：首先这篇新闻报道里说的上诉，事实上是司法复核，Judicial review。上诉成功会直接推翻之前的决定，立刻得到和之前决定相反的结果；司法复核则不会，司法复核成功只会取消之前的决定，就当之前的决定没有作出，然后再由另一位移民官来重新判定申请人的材料，重新作出决定。
申请加国学签的时候，倒读（国内本科学历申请加拿大专科，国内研究生学历申请加拿大本科或者专科）本来就非常可疑，被拒签的可能性是非常大的，除非有非常合理的理由，如同这位臧先生，这么有理有利有节的申请都要申请司法复核才能取消被拒签的决定，这还不算完，这个学签申请仍然没有成功，还是需要由另一位移民官来判定是否给予他学习许可。
